Welcome to ActiveFun (accessible via [https://activefun.com](https://activefun.com)). These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you", "user", "parent", "guardian"), and ActiveFun ("we", "us", or "our"), concerning your access to and use of the ActiveFun website, our subdirectory platforms (including /kids), and our native mobile applications (collectively, the "Platform").
Please read these Terms carefully. By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Platform and must discontinue use immediately.
ActiveFun is a hyper-local community directory and marketplace designed to connect families with sports, recreation, and youth activities. To ensure a safe environment for all members, we enforce strict eligibility criteria:
Adults Only: Children under the age of 18 are legally prohibited from registering an account on ActiveFun. All primary accounts must be created and registered by an adult, parent, or legal guardian.
Parental Responsibility: The registering parent or legal guardian assumes full legal and financial responsibility for all activities, communication, bookings, marketplace transactions, and user-generated content associated with their account.
Child Profiles: Parents may create sub-profiles for their children within their dashboard. By doing so, the parent explicitly guarantees that they are the legal guardian of the child and grants permission for the child's basic athletic data (e.g., age, sport interests) to be managed via the parental dashboard.
The Platform provides features—including activity feeds, groups, forums, messaging systems, and reviews—that allow users to upload, post, and share text, photos, and media ("User-Generated Content" or "UGC").
Prohibited Content: You agree not to post, transmit, or share any UGC that is defamatory, fraudulent, deceptive, abusive, offensive, or infringing upon the intellectual property rights of others.
Child Safety Safeguards: To protect minors within our international and local community, the exposure of children's personal identities is strictly regulated. Users (including parents and business listings) are prohibited from uploading recognizable photos, videos, or the full legal names of minors without the explicit, documented consent of that minor's parent or legal guardian.
License to the Platform: You retain full ownership of your UGC. However, by posting content on ActiveFun.com, you grant us a worldwide, non-exclusive, royalty-free, perpetual, and sublicensable license to host, display, distribute, modify, and run your content solely to operate, promote, and maintain the Platform’s features.
Content Moderation: We reserve the right, but do not assume the obligation, to monitor, edit, or permanently remove any UGC that we determine, in our sole discretion, violates these Terms or harms the community.
ActiveFun hosts a peer-to-peer marketplace allowing users to list, sell, purchase, or trade new or gently used sports gear, footwear, and recreational equipment within their local network.
Platform Venue Only: ActiveFun acts strictly as a neutral digital venue. We are not an auctioneer, retail agent, broker, or an active party to any transaction taking place between independent buyers and sellers. The legal contract for any marketplace sale is solely between the buyer and the seller.
No Warranties on Gear: ActiveFun does not inspect, test, verify, or guarantee the quality, safety, authenticity, condition, or legality of any items listed in the marketplace. All items are bought, sold, or traded "as-is" at the users' own risk.
Fraud Prevention & Privacy: To prevent unauthorized exposure and combat fraudulent actors, all communication regarding transactions must take place through our internal messaging system. Users are prohibited from using the public sections of the marketplace to broadcast private personal details, such as phone numbers or personal banking information. We reserve the right to suspend or terminate accounts engaging in suspicious or predatory trading behavior.
As a marketplace and directory hub, ActiveFun allows users to view business profiles and book classes, clinics, and activities provided by third-party clubs, venues, or coaches.
Independent Service Contracts: When you book an activity, class, or tryout, your contract for that service is directly with the respective Activity Provider (the sports club, academy, or trainer). ActiveFun is not the service provider, employer, or organizer of the physical activities listed.
Cancellations and Refunds: All scheduling, attendance requirements, postponement protocols, and refund requests are governed exclusively by the individual terms and policies of the respective Activity Provider. ActiveFun is not responsible, nor legally liable, for processing refunds, managing scheduling disputes, or compensating users for sessions canceled due to weather, trainer absence, or venue closures.
Payment Processing: All financial transactions processed through the platform are handled securely by integrated third-party payment gateways (such as iDEAL or Stripe). ActiveFun does not store raw credit card details or financial credentials on its servers.
Your privacy is foundational to our mission. Our Privacy Policy outlines in detail how we handle the collection, use, and storage of your personal data, as well as your comprehensive rights under the General Data Protection Regulation (GDPR). By agreeing to these Terms of Service, you acknowledge that you have reviewed, understood, and accept the terms of our Privacy Policy, which is fully incorporated into these Terms.
As-Is Basis: The Platform is provided on an "as-is" and "as-available" basis. You agree that your use of the Platform and participation in any activities discovered through it is at your sole risk.
Limitation of Damages: To the maximum extent permitted by applicable law, ActiveFun, its founders, and affiliates shall not be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages—including lost profit, lost revenue, or data loss—arising from your use of the website, mobile apps, marketplace, or real-world interactions with third-party service providers.
These Terms and your use of the Platform are governed by and construed in accordance with the laws of the Netherlands. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Platform shall be instituted exclusively in the competent courts located in the district governing Rijswijk, South Holland, the Netherlands.
We reserve the right to modify or replace these Terms at any time. If an amendment is material (such as a change affecting account eligibility or legal liability structures), we will provide notice by updating the date at the top of this document, sending an email notification, or displaying a prominent notice within your account dashboard before the new terms take effect. Continuing to access the Platform after updates are published constitutes binding acceptance of the revised Terms.
Donor Warranties and Representations: By listing any athletic item (including sports clothing, footwear, hockey sticks, or protective gear) for donation through the "Gear Forward" marketplace framework, you expressly warrant and represent that the equipment is structurally safe, sanitized, functional, and fit for immediate reuse. Deliberately donating compromised, broken, or hazardous equipment constitutes a material breach of these Terms.
Disclaimer of Warranties: While ActiveFun facilitates the coordination of collection via designated local hubs and performs periodic visual quality assessments, the Platform operates solely as an intermediary. ActiveFun provides no warranties of any kind, explicit or implied, regarding the safety, durability, or merchantability of donated items. ActiveFun disclaims all liability for any direct, indirect, incidental, or consequential damages, personal injury, or mechanical failures resulting from latent or patent defects in donated equipment distributed through our ecosystem.
Assumption of Risk: Participation in real-world physical volunteer initiatives organized or promoted by ActiveFun (including "Community Field Days" focused on sports ground remediation, clubhouse painting, or playground infrastructure overhauls) is entirely voluntary and undertaken at the participant's sole risk.
Indemnification and Release: ActiveFun provisions baseline raw materials, tools, and structural logistics, but does not maintain direct supervisory control over individual physical labor inputs. The participant completely releases and holds harmless ActiveFun, its founders, officers, and affiliates from any and all liability for personal injury, workplace accidents, property damage, or financial loss sustained during, or in connection with, these community engagement activities. Participants accept individual responsibility for utilizing appropriate safety gear and maintaining standard personal safety precautions.
